1. Who we are and agreeing to these terms
30DayWatercolor.com (the "Site") is owned and operated by 30 Day Lessons Inc. ("30DayWatercolor," "we," "us"). These Terms of Service ("Terms") cover your use of the Site, including joining our launch list and downloading free lessons and materials.
By using the Site or giving us your email address, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
2. We haven't launched yet
The Site describes a watercolor course, membership and kit that we plan to offer but that are not available yet.
- No purchases are processed. Clicking a "Start," "Buy" or "Get the kit" button does not place an order, start a subscription or charge you. You'll see a "coming soon" message instead, and we may invite you to join our launch list.
- We don't collect payment information during this pre-launch period.
- Details may change. Prices, plans, features, lessons, kit contents and launch dates shown on the Site are preliminary. They may change before launch, and some may not be offered at all.
- No binding offer. Nothing on the Site is an offer to sell, or a commitment to provide, any product or service.
3. Launch list and launch discount
If you join our launch list, we'll email you when the course and kit become available, along with the launch discount described on the Site when you signed up.
- The offer: the discount amount, which products it covers and how long it lasts will be stated in our launch email.
- Limits: one discount per person and per email address. It has no cash value and can't be transferred, combined with other offers or applied to past purchases.
- No obligation: joining the list doesn't commit you to buy anything.
- If plans change: if we decide not to launch, or to launch something different, we'll tell launch-list members by email. We may then close the list and delete the addresses on it, as described in our Privacy Policy.
- Leaving the list: unsubscribe at any time with the link in any of our emails.
4. Who can use the Site
You must be at least 18, or the age of majority where you live, to join our launch list or download our materials. A parent or guardian may use the free materials with a child they supervise.
The Site is intended for people in the United States. We don't claim it is appropriate or available anywhere else.
5. Free lessons and printable materials
We may offer free content, such as the Day 1 video lesson and its printable practice sheet. We give you a personal, non-exclusive, non-transferable and revocable license to watch this content and to print the practice sheet for your own non-commercial use, including with your family.
You may not resell, republish or redistribute the materials, post them publicly, or use them to teach a paid class without our written permission. You're welcome to share photos of paintings you make with our lessons. We may change or remove free content at any time.
6. Our content and intellectual property
The Site and everything on it, including text, videos, lessons, illustrations, paintings, designs, logos and the 30DayWatercolor name, belong to us or our licensors. They are protected by copyright, trademark and other laws.
Apart from the limited license in Section 5, these Terms give you no rights to our content or brand. The paintings you make by following our lessons are yours.
7. Acceptable use
When you use the Site, please don't:
- break the law or these Terms;
- sign up with someone else's email address or with false information;
- interfere with the Site, probe its security or overload it;
- scrape, copy or harvest the Site's content or other people's information by automated means;
- use the Site to send spam or malicious code.
We may block access for anyone who breaks these rules.
8. Third-party sites and services
The Site may link to, or rely on, services run by others, such as video hosts, email providers, social networks and advertising platforms. We don't control them and aren't responsible for their content or practices. Their own terms and privacy policies apply when you use them.
9. Art supplies, safety and disclaimers
Some art materials can be harmful if swallowed or misused. Follow the safety labels on your supplies, keep them away from young children and pets unless you're supervising, and paint in a ventilated space.
The Site and all of its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise any particular artistic result.
10. Limitation of liability and indemnity
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site. Because the Site is free to use during this pre-launch period, our total liability to you for any claim about the Site is limited to $100. Some states don't allow these limits, so they may not fully apply to you.
You agree to cover our losses and costs, including reasonable attorneys' fees, from claims that arise because you broke these Terms or misused the Site.
11. Governing law and disputes
California law governs these Terms, without regard to its conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally.
- Arbitration. Any dispute about the Site or these Terms that we can't resolve informally will be settled by binding arbitration administered by the American Arbitration Association (AAA) in San Francisco, California. The party starting the arbitration may choose to have it conducted by phone, online or written submissions, so neither of us has to appear in person unless we both agree. Either of us may instead bring a claim that qualifies in small claims court.
- No class actions or jury trials. You and we may bring claims against each other only individually, never as a plaintiff or class member in a class or representative action. Both of us give up the right to a jury trial.
- Intellectual property claims may be brought in the state or federal courts in San Francisco, California.
Any claim must be filed within one year after it arises, or it is permanently barred.
12. Changes, the rest of the fine print, and contact
We may update these Terms, for example when we launch. We'll post the new version on this page with a new effective date, and email launch-list members about significant changes. If you keep using the Site after an update, you accept the new Terms.
If any part of these Terms can't be enforced, the rest still applies. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
